Have you ever seen a Lumosity advertisement? I bet you have since the Lumos Labs Inc. has been widely promoting its brain-training program consisting of around 40 games. Their ads have appeared on CNN, Spotify, Fox News and virtually everywhere. According to the company, their games are designed to train several parts of the human brain.
However, the Federal Trade Commission expressed doubt regarding the truthfulness of Lumosity’s ads. They filed a lawsuit a few months ago. The untrustworthy ads claimed that Lumosity games would:
- Enhance performance on daily tasks at sports, work, and school
- Reduce effects of cognitive problems resulted by traumatic brain injury, PTSD, ADHD, chemotherapy, and other medical conditions
- Help stay sharp and avoid different cognitive impairments even at an old age
According to the FTC, the company has been playing on people’s fears regarding age-related problems such as the loss of memory or dementia. However, Lumosity’s advertisements do not have any scientific data to support them. Moreover, the company has not disclosed that its customer testimonials were not real but were a result of a competition between those who can write great reviews in return to an iPad or a trip to San Francisco.
Lumos Labs Inc. was selling online and mobile app subscriptions for $14.95 monthly and for $299.95 for a lifetime membership. And now, the company has reached the $2 million settlement with the FTC. If between January 1, 2009, and December 31, 2014, you were subscribed to Lumosity and paid at least $239 for the subscription, you might be entitled to reimbursement for deceptive advertising.
